Flávio Bolsonaro Refuses to Concede Brazil's Runoff, Will Seek Annulment Over Zanin's Extension
He says Lula's former lawyer changed the rules after the polls closed, and that his party's inspectors were pulled from the TSE's counting vault once the order came down.

Brazil's presidential runoff is over on the scoreboard, and Flávio Bolsonaro says he won't sign it. Sunday night, after the election court declared President Luiz Inácio Lula da Silva the winner, the conservative senator stood before supporters in Brasília and said it is "impossible to recognize the election result" and that he will ask for the election to be annulled.
His reason has a name: Cristiano Zanin. One minute after polls closed at 5 p.m., the Supreme Court justice, who was Lula's personal lawyer until Lula put him on the court in 2023, ordered two more hours of voting "in all polling stations in all of Brazil." Flávio's charge is simple. The rules changed after the game ended, and they were changed by the winner's old lawyer.
"What happened today was not normal. It was, in fact, unacceptable," Flávio said. "A Supreme Court justice, for the first time in history, Lula's former lawyer, signs an order at the request of his former partner and changes the rules in the middle of the game." Zanin, he noted, "isn't even on the Superior Electoral Court," the TSE, the court Brazil built to run elections.
Why he says he can't accept it
Flávio's case rests on fairness between voters. Zanin's order said every station in the country, but most had already sealed their machines by the time it landed, and a sealed Brazilian voting machine can't be switched back on. So some places voted until 7 and others didn't. "There was a total breach of equal treatment among Brazilians in different cities and different states," Flávio said. "I'll never know, in a state where the polls weren't reopened, how many votes I could have had."
Think of a soccer match where the referee adds extra time, but only on one half of the field, and only after the final whistle. Whoever wins, the other side is going to ask for the tape.
Then he dropped a new claim nobody had reported. "Our PL inspectors were removed from inside the vault room from the moment that decision was made," he said. The vault room, the sala-cofre, is the locked TSE room where the national count is totaled. Party inspectors first won access to it in 2018, after Jair Bolsonaro's campaign asked for it. The TSE had not publicly answered Flávio's claim as of this report.
"I won't accept that the rules of the game were changed in the middle of the game once again by Lula's friends on the Supreme Court," he said. "There's a lot to be cleared up before Brazil simply recognizes this screw job that just happened in the elections. I will not give up on my Brazil."
Even a Supreme Court justice floated a do-over
Flávio said that "in the words of some justice that the press itself published," the election should have been annulled. That's real. On Sunday evening, before the result, a Supreme Court justice told Valor Econômico, on condition of anonymity, that with the TSE failing to decide in time, the best path would be to annul the runoff and hold it again on a new date. The same justice said Brazil's election courts were embarrassing themselves.
Folha de S.Paulo found justices on both courts who think both courts botched it. Lula's campaign filed at the Supreme Court at 3:46 p.m., it took almost an hour to assign the case to Zanin, and his office released the order a half hour after that. A group on the Supreme Court faulted TSE President Kassio Nunes Marques for not ruling quickly on the bus complaints. Two justices allied with Zanin told Folha there are no grounds to annul, because the Constitution fixes the runoff on the last Sunday of October.
The 'former partner' and the 'you asked too' reply
The petition Zanin granted was signed by Ferraro e Novaes Advogados for Lula's coalition. Its lead lawyer, Angelo Ferraro, runs Lula's campaign legal team, and in the 2022 campaign Zanin's own law firm worked on that team alongside him, Valor reported in March. Zanin did not step aside.
Lula's defenders have a comeback ready: Flávio's campaign asked for more time too. It did, for specific rain-hit towns in southern states like São Paulo, Paraná and Santa Catarina, and it asked the TSE, the court that is supposed to decide. Lula's campaign asked the TSE too, then went over its head to the Supreme Court before it ruled, and walked out with an order for the whole country from a justice who used to be Lula's lawyer. Those are not the same thing.
Everyone in power already signed off
The establishment moved fast. The heads of the Supreme Court, Edson Fachin; the TSE, Nunes Marques; the Senate, Davi Alcolumbre; and the Chamber, Hugo Motta, all recognized the result Sunday night, O Globo reported. Nunes Marques, a Jair Bolsonaro appointee, said he has "absolute confidence in the whole electoral process." Prosecutor General Paulo Gonet said "respect for the will expressed at the ballot box strengthens democratic institutions."
With 99.99% of stations counted, Lula had 51.78% to Flávio's 48.22%, a margin of more than four million votes, and the most votes any Brazilian presidential candidate has ever received. Flávio had led the first round on Oct. 4 and led the final Datafolha poll. In his victory speech in São Paulo, Lula said he had to beat outside "interference" from social media platforms and pushed again for regulating them, g1 reported. Brazil already shut X off nationwide for more than a month in 2024; that line should worry anyone who posts there.
In the U.S., the loudest reaction came from Donald Trump Jr., quoting Martin De Luca, the American lawyer who represents Trump Media and Rumble in their lawsuit against Brazilian Justice Alexandre de Moraes. De Luca asked whether Lula expects "anyone in the international community to recognize that as a free and fair election."

What happens next

Flávio hasn't filed anything yet, and he hasn't said which case he'll bring. Brazilian law gives him a few doors. The TSE has until Dec. 18 to certify Lula. After that, the Constitution allows a 15-day window to challenge a winner's mandate in the election courts with proof of abuse of economic power, corruption or fraud. And the Electoral Code has a bigger lever. If voided votes reach more than half of the country's votes in a presidential race, the TSE must call a new election within 20 to 40 days.
Any of those roads runs through the same two courts Flávio is accusing, the TSE and a Supreme Court where Zanin sits. Lula, who turns 81 on Tuesday, is due to start his fourth term on Jan. 5, 2027. Zanin's own second order on Sunday left a door open, saying his ruling came "without prejudice to the necessary investigations in due course and their legal consequences." Flávio just told Brazil he intends to walk through it.
