More than 13 months after Charlie Kirk was shot dead on stage at Utah Valley University, the man charged with killing him still has no trial date. Fourth District Judge Tony Graf heard three hours of arguments in Provo on Friday over when Tyler Robinson, 23, should face a jury, then sent everyone home without a decision. He says he will rule on Nov. 9 (Deseret News; KSL).

Graf had planned to set the schedule at the end of the hearing. Instead he said he needed more time to weigh the lawyers' timelines and their other trial commitments. "I am not going to run back into my office and type quickly and kick something out," he said (Deseret News). He did not promise that the Nov. 9 order will include trial dates at all (KSL).

The delay came the same day President Trump blasted Graf on Truth Social, saying the case "should be tried within a month, not three years" and that the judge is "desecrating the memory of the Great Charlie Kirk" (ABC4; our earlier report).

The defense: we're a quarter of the way through

Robinson's lawyers want a "soft target" in the third quarter of 2029 for a trial they say would run about seven months, and they called setting any date now "premature" (Fox News; Deseret News).

Defense attorney Staci Visser told the court the team has more than 31,000 pieces of discovery and "8 million" digital files to go through, and estimated they are only about 25% of the way through. She said they need at least nine more months, "but realistically a year," just to finish that review (KSL; Fox News). "The reality is that rushing to trial does not lead to closure," Visser said. "It leads to mistakes" (KSL).

The defense also says it may ask to move the trial out of Utah County, and attorney Kathryn Nester estimated that fight alone could take five or six months (KSL). And one of Robinson's lawyers, Richard Novak, already has a federal racketeering trial set for Jan. 10, 2028, which collides with the state's preferred start (Fox News).

Prosecutors pushed back on the size of that pile. Deputy Utah County Attorney Ryan McBride said much of the discovery is one- or two-page PDFs, many of them tips from the public that went nowhere, and that the state has already turned over everything it has, apart from a few items still in dispute (KSL). Picture a moving company billing you for a full truck when half the boxes are empty.

Timeline from Sept. 10, 2025, when Charlie Kirk was shot, to the three proposed trial starts: Erika Kirk asks for no later than Oct. 4, 2027; prosecutors propose Jan. 31, 2028 for a 17-week trial; Robinson's defense proposes the third quarter of 2029 for a six-to-seven-month trial.

The state: ready by October 2027

Utah County prosecutors say they can be ready in October 2027. They proposed Jan. 31, 2028 for a 17-week trial only to keep jurors out of the courtroom over Thanksgiving and Christmas, when it is hardest to keep a jury from talking about a case (Fox News; Deseret News). Deputy county attorney Chad Grunander asked Graf to make the dates "as firm as possible" (KSL).

Deputy county attorney Christopher Ballard rejected the defense's claim that a death-penalty case automatically needs years more. "Even though death differs from any other type of punishment โ€ฆ the same due process standards apply throughout this case as they would in any other case," he said (Deseret News). The defense, he argued, is not entitled to more resources or different rules (KSL).

The widow's lawyer: "Set it, please"

Jeffrey Neiman, the lawyer for Charlie's widow, Erika Kirk, asked Graf to throw out the 2029 timeline. "Every day of delay adds to uncertainty, invites speculation, and that erodes confidence in this system," he said (Fox News). "Justice delayed this long stops being justice for the Kirk family" (Deseret News).

He noted that Kirk's children, who were 1 and 3 when their father was killed, will spend more time waiting for this trial than they spent with him. When both sides said a holiday trial would be hard on jurors, Neiman answered that every holiday the Kirk family has now is one without Charlie. "Time is the defense's best ally," he said. "This case should be a priority for everyone involved. The Kirk family deserves that. If you set (trial), it will happen. Set it, please" (KSL).

Erika Kirk's legal team had already filed a victim's motion under Utah's speedy-trial protections asking for trial no later than Oct. 4, 2027 (ABC4).

What's next

Graf asked both sides to send him written lists of their other upcoming trials before Nov. 9 so he can find dates everyone can make. He said that until he sets dates there is no "frozen period" on anyone's calendar, so other trials keep getting booked in the gaps (KSL; Deseret News). Both sides expect to mail juror questionnaires to about 3,000 people when the time comes (KSL).

Robinson is charged with aggravated murder and six other counts, and prosecutors are seeking the death penalty. He did not speak in court Friday and was driven away in an armored police vehicle (Fox News; Frontlines TPUSA on ๐•). Prosecutors say they could be ready in a year. Robinson's own lawyers want about three. On Nov. 9, the judge decides whose clock this case runs on.
